Bandung, Indonesia – October 7, 2025 – The fundamental principles guiding Indonesia's national identity took center stage at the 5th UiTM International Conference on Law & Society 2025 (UiTM i-CLaS 2025), where Dadi Mulyadi Nugraha, M.Pd., a distinguished lecturer from the Law Study Program at FPIPS UPI, presented a vital study. His research, titled "LEGAL ANALYSIS OF PANCASILA EDUCATION IN HIGHER EDUCATION FROM AN EDUCATIONAL LAW PERSPECTIVE," delves into the critical role and current challenges of embedding Pancasila's core tenets within the nation's higher education system.

Pancasila, serving as the philosophical bedrock and ideological compass of the Indonesian nation, encapsulates five fundamental principles: belief in one God, just and civilized humanity, the unity of Indonesia, democracy guided by the wisdom of deliberation among representatives, and social justice for all Indonesians. Within the realm of higher education, Pancasila education is not merely an academic subject; it is a compulsory course designed to fortify students’ moral integrity, cultivate civic consciousness, and reinforce their national identity. Mr. Nugraha's study meticulously dissects the legal foundations, inherent challenges, and profound implications of Pancasila education from a crucial educational law perspective.
Employing a rigorous normative juridical approach, the research meticulously examined a spectrum of legal instruments, including constitutional provisions, statutory regulations, and ministerial policies. This analysis was further enriched by conceptual and philosophical explorations of various educational and legal theories. The findings unequivocally affirm that the legal basis for Pancasila education is deeply entrenched and robust, anchored firmly in the 1945 Constitution, Law No. 12 of 2012 on Higher Education, and Presidential Regulation No. 87 of 2017 on Strengthening Character Education.
However, despite this strong legal foundation, the study identifies persistent challenges that hinder its effective implementation. A significant hurdle lies in harmonizing these legal mandates with the crucial principles of institutional autonomy and academic freedom, which are cornerstones of higher education. The absence of clear and standardized enforcement mechanisms, coupled with discernible disparities in curriculum implementation across various universities, has led to a wide array of interpretations. Consequently, Pancasila education is often reduced to a mere formal requirement, inadvertently diluting its potential as a truly transformative learning process.
From an educational law perspective, Mr. Nugraha posits that Pancasila education embodies the state's constitutional duty to institutionalize its core ideology through moral and civic education. This duty, he emphasizes, must be carefully balanced with the imperative of academic independence to foster a vibrant intellectual environment. To address these complex issues, the study proposes several forward-thinking recommendations, including:
